California Labor Dept Conducts Sweeps - $771,850 in Fines

For those detailers operating in the State of California who might not know, or might not think that the California Labor Dept is not serious about enforcing the mandatory registration for any business involved in the carwashing and/or detailing business, think again.

A recent sweep of 231 such operations (72 detail operations) throughout California resulted in fines of $771,850 or an average of $3442 per location.

While the sweep was conducted to find specific violators of the registration law, the inspectors found numerous violations including:

Failure to register
Failure to renew registration
Various Worker Compensation Insurance violations
Several multiple violations
Child Labor Violations
Minimum Wage Violations

It is interesting to note that of the 231 businesses involved in the sweeps, less than 50 were members of a trade association.

You are referring to just having a valid business license , right?

This has nothing to do with having a business license.

The State of California passed a special law that required "all" car wash and auto detailing businesses to register with the State of California. It costs, I believe $250 dollars per year to register.

If you do not register you are in violation of the law and can be fined. Not certain the exact fine cost, but it is not inexpensive.

What they Labor Commission has done is make "sweeps" of car wash and detail businesses all over California to check for registerations.

Not only have they found violations of the registration law, but Workers Comp violations; OSHA violations; Child Labor Law violations; EPA violations, etc.

The recent sweep which resulted in the nearly $772,000 in fines was not just for violating the registrations laws it was for a number of other violations.

If you operate in the State of California and have not registered it behooves you to register NOW, especially if you are violating other laws and regulations.

The California Labor Commissioner, Angela Bradstreet filed suit in the California Courts for the closure of several detail businesses and car washes in the State for repeated failure to register their detail or car wash business with the State in accordance with the law.

She pointed out that they are sending a strong message to those in the industry that they mean business and if you do not file you will be fined and repeated violations could result in closure of your business.

The law was to expire in 2010, but due to the lack of registration of detail shops and car washes there is now a bill in the California legislature to make the registration law PERMANENT.

If you operate in California, you better get registered.

California, keep handcuffing your businesses in trying to makeup for stupid decisions by your leadership. Toyota closing your plant, firing over 4,500 people and bringing those jobs to San Antonio, TX. When are you going to say, "Enough Is Enough!" God Bless Texas And Our Leadership
